2. Acceptance of Terms
By downloading, accessing, or using the Breathe Free with Me app or visiting this website, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must not use our services.
We may update these terms from time to time. Material changes will be notified via the app or email before they take effect. Where a change requires your consent, we will ask for it explicitly. You may delete your account at any time if you do not wish to continue under revised terms.
3. What the App Is (and Is Not)
Breathe Free with Me is a lifestyle and wellness application designed to support awareness, reflection, and positive behaviour change around nicotine use. It provides tools for daily reflection, habit tracking, environmental impact awareness, and peer community support.
- The app does not diagnose nicotine dependence
- The app does not prescribe treatments or medications
- The app does not provide clinical interventions
- Features such as breathing exercises are for general wellness only
- Community support features are peer-to-peer and are not moderated by healthcare professionals

4. Eligibility
You must be at least 16 years of age to create an account and use Breathe Free with Me. By using the app you confirm that you meet this requirement.
You must also be legally permitted to enter into a contract in your jurisdiction.
5. Your Account
To access the full features of the app you will need to create an account. You are responsible for:
- Keeping your login credentials secure and confidential
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access at support@breathefreewithme.com
We reserve the right to suspend or terminate accounts that violate these terms, engage in harmful behaviour, or are inactive for an extended period (with prior notice).
6. Acceptable Use
When using Breathe Free with Me, particularly community features, you agree not to:
- Post content that is abusive, harassing, threatening, or discriminatory
- Share false or misleading health information
- Promote commercial products or services
- Upload malicious code, viruses, or disruptive content
- Attempt to access other users' accounts or data
- Use the app in any way that violates applicable laws
- Impersonate any person or organisation
Violation of these terms may result in immediate account suspension and, where required by law, reporting to relevant authorities.
6a. Environmental Impact Claims
Our environmental impact estimates (CO₂ avoided, cigarette butts, microplastics, nicotine pollution, water depletion, lithium use) are:
- Illustrative estimates based on published peer-reviewed research
- Modelled calculations rather than verified environmental measurements
- Not carbon offsets or certified environmental credits
- Subject to variation based on region, product type, and individual usage

6b. User Content
You retain ownership of any content you create within the app (for example, custom awareness item names and personal reflection notes).
By using the app, you grant us a limited, non-exclusive licence to process your content solely for the purpose of providing the service to you. We may use aggregated, fully anonymised data for statistical and research purposes. We will never identify you personally in any published statistics.
7. Intellectual Property
All content within Breathe Free with Me, including the app design, text, graphics, logo, features, and functionality, is owned by or licensed to Breathe Free with Me and is protected by applicable intellectual property laws.
You may not copy, modify, distribute, sell, or reverse engineer any part of the app without our prior written consent.
Content you create within the app (such as personal reflections and notes) remains yours. You grant us a limited licence to process it for the purpose of providing the service.
8. Limitation of Liability
To the maximum extent permitted by law, Breathe Free with Me shall not be liable for:
- Any health outcomes resulting from use of the app
- Loss of data due to technical failure (although we take reasonable precautions)
- Third-party services or links accessed through the app
- Indirect, consequential, or incidental damages of any kind
Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
Our total liability to you for any claim arising from these terms will not exceed the total amount you have paid to us in the 12 months prior to the claim.
9. Your Data Rights Under GDPR
Your personal data is processed in accordance with our Privacy Policy, which forms part of our agreement with you. You have the right to:
- Access all personal data we hold about you
- Request correction of inaccurate data
- Request deletion of your account and all associated data
- Data portability: receive your data in a structured format
- Object to processing in certain circumstances

10. Termination
You may delete your account at any time from within the app or by contacting support@breathefreewithme.com. Upon deletion, all personal data will be permanently removed within 30 days.
We may terminate or suspend your access if you breach these terms or if we are required to do so by law. Where possible, we will provide advance notice.
11. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of England and Wales.
If you are a consumer resident in the EU, you also benefit from any mandatory protections afforded by the laws of your country of residence, and you may bring proceedings in the courts of your own country. Nothing in these terms affects your rights as a consumer under applicable local law.
